These Terms govern your use of pool·heater, operated by Pomello LLC. By using the app, you agree to them. If you don’t agree, please don’t use the service.
The service
pool·heater lets you monitor and control a compatible iAqualink (Jandy) pool system from your phone or browser. The service is provided “as is” and depends on third-party systems — including the iAqualink cloud — that are outside our control.
Your account
You’re responsible for keeping your sign-in and your iAqualink credentials secure, and for activity that happens under your account. Provide accurate information and keep it current.
Subscriptions and billing
Paid features require a subscription purchased through Apple’s In-App Purchase. The price is shown at purchase (currently $2.99/month or $19.99/year) and renews automatically until you cancel. Manage or cancel your subscription in your Apple account settings; refunds are handled under Apple’s policies.
Acceptable use
Don’t misuse the service: no attempting to access systems or data that aren’t yours, no interfering with the service’s operation, and no unlawful use.
Disclaimers
Pool control is best-effort and depends on network and vendor cloud availability. We don’t guarantee that a command will succeed, that the pool will reach a target temperature, or that notifications will always arrive. You are responsible for your pool equipment and its safe operation. We are not liable for equipment damage, energy costs, or missed heating.
Limitation of liability
To the fullest extent permitted by law, Pomello LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you paid for the service in the 12 months before the claim.
Termination
You may stop using the service at any time. We may suspend or end access if these Terms are violated or to protect the service.
Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
Changes
We may update these Terms from time to time. Continued use after an update means you accept the revised Terms; we’ll revise the “Last updated” date above.
